Terms of Service

Agreement and eligibility

You must be at least 18 years old and able to enter a binding agreement. If you use Email Bump for a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

Accounts and security

You must provide accurate account information, keep it current, protect credentials and API keys, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account and for the users you invite. You may not share access in a way that circumvents security or impersonates another person.

The service

Email Bump provides tools for marketing campaigns, transactional messages, automated flows, contact management, forms, segmentation, editing, reporting, APIs, webhooks, and related email operations. We may improve or modify the service over time. Material changes that substantially reduce paid functionality will be handled as required by applicable law and any applicable order.

Email delivery depends on recipient systems, internet providers, sender reputation, customer configuration, and other factors outside our control. We do not guarantee inbox placement, open rates, delivery to every recipient, or uninterrupted operation.

Customer data and instructions

You retain ownership of content, contact data, templates, domains, and other information you submit to Email Bump. You grant Email Bump and its service providers a limited right to host, copy, transmit, modify, and otherwise process that data only as needed to provide, secure, support, and improve the service and comply with law.

You represent that you have all rights and permissions needed for the data and instructions you provide. You may export or delete data using available product features and may contact support for assistance.

Acceptable use

You may not use Email Bump to:

• Send spam or email to recipients without the permission or other lawful basis required by law.
• Use purchased, rented, scraped, harvested, or unlawfully obtained address lists.
• Send phishing, fraudulent, deceptive, abusive, hateful, harassing, or illegal content.
• Distribute malware, malicious code, or content that compromises systems or accounts.
• Hide sender identity, falsify headers, evade unsubscribe requests, or bypass suppression controls.
• Probe, disrupt, overload, reverse engineer, or gain unauthorized access to the service.
• Resell or provide the service to third parties except under a written agreement that permits it.
• Use the service in a way that violates law, third-party rights, or applicable provider policies.

Email and recipient responsibilities

You are responsible for complying with applicable privacy, electronic-communications, and marketing laws. This includes maintaining appropriate consent or another lawful basis, identifying the sender, providing required notices and physical-address information, honoring opt-outs promptly, and maintaining accurate suppression records.

You must monitor bounces, complaints, and engagement, follow reasonable deliverability guidance, and avoid practices that threaten Email Bump's infrastructure or other customers.

Google sign-in

Google sign-in is an optional authentication method. Your use of Google services is also subject to Google's applicable terms and privacy policy. You authorize Email Bump to use the basic identity information described in our Privacy Policy to create, link, and authenticate your account. You may revoke the connection through your Google Account, but you may need another supported login method to continue accessing the service.

Plans, billing, and fair use

Plan prices, allowances, billing intervals, and included features are shown at purchase or in an applicable order. Paid subscriptions renew automatically for the selected interval until canceled. You authorize Stripe and Email Bump to charge applicable fees and taxes. Except where required by law or stated in an order, fees are non-refundable.

You can manage or cancel a paid subscription through the billing portal. Changes may take effect immediately or at the next renewal as shown during the change. "Unlimited" usage is subject to fair use, technical safeguards, lawful sending, and measures needed to protect deliverability and service reliability. Transactional and contact allowances remain subject to the limits displayed for the selected plan.

Ownership and feedback

Email Bump and its licensors own the service, software, designs, documentation, trademarks, and related intellectual property, excluding customer data. These Terms give you a limited, non-exclusive, non-transferable right to use the service during your account term. If you provide feedback, you permit us to use it without restriction or compensation.

Suspension and termination

You may stop using the service at any time. We may suspend or limit access when reasonably necessary to address security risks, abuse, unlawful activity, nonpayment, provider or deliverability threats, or a material breach of these Terms. Where practicable, we will provide notice and an opportunity to resolve the issue.

After termination, your right to use the service ends. Provisions that by their nature should survive will remain effective, including payment obligations, ownership, warranty disclaimers, limitations of liability, and dispute terms.

Disclaimers and liability

To the maximum extent permitted by law, the service is provided "as is" and "as available." Email Bump disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing.

To the maximum extent permitted by law, Email Bump will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Email Bump's aggregate liability arising from the service will not exceed the amount you paid to Email Bump during the 12 months before the event giving rise to the claim, or USD $100 if you paid nothing. Some jurisdictions do not allow certain exclusions, so these limits apply only to the extent permitted.

You will defend and indemnify Email Bump from third-party claims arising from your customer data, email practices, violation of law, or material breach of these Terms, except to the extent caused by Email Bump's own breach or misconduct.

General terms and contact

These Terms and any applicable order are the complete agreement concerning the service. If they conflict, the order controls for that conflict. You may not assign the agreement without our consent, except in connection with a merger or sale of substantially all assets. Email Bump may assign it as part of a reorganization, financing, merger, or sale.

If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. The laws applicable where Email Bump is established govern these Terms unless mandatory law provides otherwise. Before filing a formal claim, both sides agree to try in good faith to resolve it by contacting the other side.
